1. Acceptance of Terms

By downloading, installing, or using our applications, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our applications or services. MCK Dynamics reserves the right to modify these terms at any time, and such modifications shall be effective immediately upon posting. Your continued use of our applications following any changes constitutes your acceptance of such changes.

2. Use License

MCK Dynamics grants you a limited, non-exclusive, non-transferable license to download and use our applications solely for your personal, non-commercial purposes. You may not:

• Modify or create derivative works based on our applications
• Use our applications for any commercial purpose
• Attempt to decompile or reverse engineer any portion of our applications
• Remove any copyright or other proprietary notations
• Transfer the applications to another person or "mirror" them on any other server
• Use our applications in any way that violates any applicable local, national, or international law or regulation
• Use our applications to transmit any data that contains viruses, Trojan horses, worms, or any other harmful or destructive programs

3. User Content

Some of our applications may allow you to submit content. You retain all rights in any content you submit, post, or display through our applications. By submitting content, you grant MCK Dynamics a worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content in connection with providing our services.

You represent and warrant that: (a) you own or have the necessary licenses, rights, consents, and permissions to use and authorize MCK Dynamics to use all patent, trademark, trade secret, copyright, or other proprietary rights in and to any and all content you submit; (b) the content you submit does not violate the rights of any third party; and (c) the content you submit does not contain material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.

4. Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information when you use our applications. By using our applications, you agree to the collection and use of information in accordance with our Privacy Policy.

6. Termination

MCK Dynamics may terminate or suspend your access to our applications immediately, without prior notice, for conduct that we believe violates these Terms of Service or is harmful to other users, MCK Dynamics, or third parties, or for any other reason at our sole discretion.

Upon termination, your right to use our applications will immediately cease. If you wish to terminate your account, you may simply discontinue using our applications. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Disclaimer of Warranties

Our applications are provided "as is" and "as available" without warranties of any kind, either express or implied. MCK Dynamics does not warrant that our applications will be uninterrupted or error-free, that defects will be corrected, or that our applications are free of viruses or other harmful components.

To the fullest extent permitted by applicable law, MCK Dynamics disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. MCK Dynamics does not warrant that the functions contained in our applications will meet your requirements or that the operation of our applications will be uninterrupted or error-free.

8. Limitation of Liability

In no event shall MCK Dynamics be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use our applications.

To the maximum extent permitted by applicable law, MCK Dynamics's total liability to you for any claims arising out of or relating to these Terms or your use of our applications shall not exceed the amount paid by you, if any, for accessing our applications during the twelve (12) months preceding the event giving rise to the liability.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

You agree that any legal action or proceeding between you and MCK Dynamics for any purpose concerning these Terms or the parties' obligations hereunder shall be brought exclusively in a court of competent jurisdiction sitting in South Africa. You hereby waive any right to a trial by jury in any such action or proceeding.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our applications after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use our applications.
